Medysense Terms of Service

Welcome to Medysense. These Terms of Service ("Terms") form a binding agreement between you ("you" or "User") and Medysense Health Technologies ("Medysense," "we," "us," or "our"). They govern your access to and use of the Medysense mobile application, website, and all related services (collectively, the "Platform"). Please read them carefully. By creating an account or using the Platform in any way, you confirm that you have read, understood, and agree to these Terms. If you do not agree, you should not use the Platform.
1. About the Platform
Medysense is a health-technology platform that connects patients with licensed medical professionals for consultations, appointment booking, and general health guidance. We also provide an AI-powered health assistant called Amelia, which can help you search for doctors, get general health information, and manage appointments.
Medysense does not provide medical diagnoses, prescriptions, or treatment. The Platform exists to make it easier for you to find and communicate with qualified healthcare providers. All clinical decisions and medical care are the sole responsibility of the medical professionals you engage through the Platform.
2. Eligibility
You must be at least 16 years old to create an account and use the Platform. By registering, you represent that you meet this age requirement. If you are between 16 and 18, you confirm that you have the consent of a parent or legal guardian to use the Platform.
3. Account Registration and Security
- To access most features, you need to create an account using your email address, phone number, or a supported social login provider (Google or Facebook).
- You must provide accurate, current, and complete information during registration and keep your profile up to date.
- You are responsible for keeping your login credentials confidential. Do not share your password with anyone.
- You are liable for all activity that occurs under your account. If you suspect unauthorised access, notify us immediately at support@medysense.app.
- We reserve the right to suspend or terminate accounts that contain false information or are used in violation of these Terms.
4. User Conduct
When using the Platform, you agree that you will not:
- Violate any applicable local, state, national, or international law or regulation.
- Provide false, misleading, or inaccurate information about yourself or your health history.
- Impersonate any person or entity, or falsely claim an affiliation with any person or entity.
- Harass, threaten, abuse, or intimidate other users, medical professionals, or Medysense staff.
- Upload or share content that is defamatory, obscene, offensive, discriminatory, or infringes on the intellectual property or privacy rights of others.
- Attempt to gain unauthorised access to other users' accounts, our servers, databases, or any part of the Platform's infrastructure.
- Use automated scripts, bots, or scraping tools to access or collect data from the Platform.
- Interfere with, disrupt, or place an unreasonable burden on the Platform or its networks.
- Use the Platform for any purpose other than its intended use — connecting patients with medical professionals and accessing health-related features.
We reserve the right to investigate and take appropriate action against anyone who violates these rules, including removing content, suspending accounts, and reporting conduct to law enforcement where appropriate.
5. Medical Services and Consultations
5.1 Role of Medysense
Medysense is a technology platform, not a healthcare provider. We facilitate connections between patients and independent, licensed medical professionals. We do not employ doctors or other healthcare providers who use the Platform, and we do not control the medical advice, diagnoses, or treatments they offer.
5.2 Medical Professional Responsibility
Each medical professional on the Platform is independently responsible for:
- Maintaining valid and current professional licences and certifications.
- Providing competent, ethical, and lawful medical care.
- Obtaining your informed consent before any examination or treatment.
- Maintaining their own malpractice or professional liability insurance.
5.3 Patient Responsibility
As a patient, you acknowledge that:
- The information you share on the Platform (including your health profile, allergies, medications, and conditions) should be accurate and complete. Inaccurate information may lead to inappropriate medical guidance.
- Medysense and Amelia AI are not substitutes for professional medical advice, diagnosis, or treatment. Always seek the advice of a qualified healthcare provider for any medical condition.
- In a medical emergency, you should call local emergency services immediately rather than relying on the Platform.
5.4 No Guarantee of Availability
We do our best to connect you with available professionals in your area, but we cannot guarantee that a professional will be available at any given time or location. Appointment scheduling is subject to professional availability and acceptance.
6. Amelia AI Health Assistant
Amelia is an AI-powered assistant integrated into the Platform. Amelia can help you search for doctors, answer general health questions, and assist with booking appointments.
- Amelia's responses are generated by artificial intelligence and are intended for informational purposes only. They do not constitute medical advice, diagnosis, or treatment.
- Amelia may reference information from your health profile (allergies, medications, conditions) to provide more relevant responses. You can review and update this information in your profile settings at any time.
- You should not rely solely on Amelia's output for making health-related decisions. Always consult a licensed medical professional for personalised medical advice.
- Medysense is not liable for any actions you take or fail to take based on information provided by Amelia.
7. Payments and Wallet
7.1 Fees
Certain services on the Platform, such as consultations and home visits, may require payment. The applicable fees will be clearly displayed before you confirm a booking. By proceeding with a booking, you agree to pay the stated fee.
7.2 Wallet
The Platform includes a digital wallet feature that allows you to fund your account and pay for services. Wallet funds are non-transferable between users.
7.3 Payment Processing
Payments are processed through Paystack, a third-party payment provider. We do not store your full credit or debit card details on our servers. All payment transactions are subject to Paystack's terms and conditions.
7.4 Refunds
Refund eligibility depends on the specific circumstances of a cancelled or disputed booking. If a medical professional fails to attend a confirmed appointment, you may be eligible for a full refund. Refund requests should be submitted to support@medysense.app within 7 days of the scheduled appointment. We will review each request on a case-by-case basis.
8. Content and Intellectual Property
8.1 Our Content
The Platform and all of its content — including text, graphics, logos, icons, images, software, and the Medysense and Amelia names and branding — are the property of Medysense Health Technologies or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Platform or its content without our prior written consent.
8.2 Your Content
When you upload files, images, or messages through the Platform (for example, during a consultation chat or when updating your profile), you retain ownership of that content. However, you grant Medysense a limited, non-exclusive licence to store, display, and transmit that content solely for the purpose of operating the Platform and delivering services to you. This licence ends when you delete the content or your account.
9. Privacy
Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, store, and protect your personal data. By using the Platform, you consent to the data practices described in our Privacy Policy.
10. Account Suspension and Termination
- We may suspend or terminate your account at any time, with or without notice, if we reasonably believe you have violated these Terms or engaged in conduct that could harm other users, medical professionals, or Medysense.
- You may delete your account at any time through the app (Settings → Account → Delete Account) or by emailing support@medysense.app. Account deletion is permanent and you will lose access to all data, consultation history, and wallet balance associated with the account.
- Sections of these Terms that by their nature should survive termination (including intellectual property, limitation of liability, and indemnification) will remain in effect after your account is closed.
11. Disclaimers
- The Platform is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the Platform's reliability, accuracy, availability, or fitness for a particular purpose.
- We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components.
- We do not endorse, guarantee, or assume responsibility for the quality, safety, or legality of any medical services provided by professionals on the Platform.
- Information provided by Amelia AI is generated by artificial intelligence and may not always be accurate or complete. It should never be used as a substitute for professional medical advice.
12. Limitation of Liability
To the maximum extent permitted by applicable law:
- Medysense, its directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Platform.
- Our total aggregate liability for any claims arising from these Terms or your use of the Platform shall not exceed the amount you have paid to Medysense in the 12 months preceding the claim.
- We are not liable for any harm, injury, misdiagnosis, or adverse outcome resulting from medical advice, treatment, or services provided by medical professionals accessed through the Platform.
13. Indemnification
You agree to indemnify, defend, and hold harmless Medysense, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) your violation of any third party's rights.
14. Third-Party Services
The Platform integrates with third-party services including Paystack (payments), Google Maps (location), Firebase (notifications), and others. Your use of these third-party services is subject to their respective terms and privacy policies. Medysense is not responsible for the practices or content of third-party services.
15. Governing Law and Disputes
These Terms are governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Any disputes arising from or related to these Terms or your use of the Platform shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to the exclusive jurisdiction of the courts located in Lagos, Nigeria.
16. Changes to These Terms
We may revise these Terms from time to time. When we make material changes, we will notify you through an in-app notification or by email at least 7 days before the updated Terms take effect. Your continued use of the Platform after the effective date constitutes your acceptance of the revised Terms. If you do not agree with any changes, you should stop using the Platform and delete your account.
17. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
